TOWN OF HOLDEN
ZONING BOARD OF APPEALS
HEARING

FRANCIS T. & BETTY ANN WARNER                                                  CASE NO. V1206
                        
The Zoning Board of Appeals held a public hearing on June 21, 2012 at 7:15 p.m. in the Selectman’s Room at the Starbard Building, 1204 Main Street, Holden, MA on the Petition of Francis & Betty Ann Warner for property located at 116 High Street for a VARIANCE for relief from front & side yard setback requirements & lot area requirements for an addition.
 
Members in attendance:  R. Spakauskas, S. Annunziata, R. Fraser, J. Deignan and R. Butler.

The Chairman called the meeting to order. Since there were no objections, the reading of the legal notice and list of abutters was waived.  The secretary read the application and findings of fact.

Mr. John Boyce, the architect representing the applicant, addressed the Board.  He explained to the Board that the applicants are the custodials and prime care givers to an elderly parent.  They are in the process of making handicapped accessible living space for this parent.  They need additional floor space and would like to add a screened porch out back for their comfort.  Due to the fact that the house was built prior to the enactment of the Holden Zoning Bylaws, it is considered a pre-existing, non-conforming structure and does not meet the lot area or required setbacks.

J. Deignan asked if this is intending to be an accessory apartment.  Mr. Boyce answered no; it will just be an extended family.

Since there were no further comments or questions, the public hearing was closed at 7:25 p.m.

The Board unanimously voted to approve the variance with the following conditions:  1)  The addition must be set back at least three feet (+/- one foot) from the front of the building; and 2)  The Board accepted the plan submitted dated May 23, 2012 and referred to as S-1.
